On June 27, 2001, Norman resident Robert Braver filed a formal Complaint and Application for Emergency Relief with the Oklahoma Corporation Commission in an attempt to stop two area businesses' auto-dialed, prerecorded telemarketing campaigns. The press release is here.
The Complaint before the Oklahoma Corporation Commission was DISMISSED on the grounds that there are civil actions pending against both companies in Cleveland County District Court. The judge's order with further explanation has not yet been issued. I will post it here when I have it. In the meantime, my civil cases are proceeding.
Somehow the parts in the Corporation Commission's procedures about getting the administrative law judge's order and having a chance to appeal it to the full commission got skipped, and all I got was the rubber-stamped order of the Commissioners since it went uncontested.
An Edmond resident has also filed a complaint against Jeff Citro with the Corporation Commission. After extensive briefing by both parties, the administrative law judge ruled that a private consumer does not have standing to bring such a complaint before the Commission. He also had his opportunity to review and respond to the ALJ's findings passed over. The desicion as well as the failure to follow procedure is presently being appealed to the Oklahoma Supreme Court.
